IN THE SUPREME COURT OF THE STATE OF DELAWARE IN THE MATTER OF THE PETITION OF GRACE MURRAY FOR A WRIT OF MANDAMUS § § No. 347, 2006 § Submitted: July 24, 2006 Decided: September 14, 2006 Before STEELE, Chief Justice, JACOBS, and RIDGELY Justices. ORDER This 14th day of September 2006, upon consideration of Grace Murray s petition for a writ of mandamus and the State=s answer and motion to dismiss, it appears to the Court that: (1) Murray filed a petition requesting this Court to issue an extraordinary writ of mandamus directed to the Superior Court. Murray asks that the Superior Court be directed to issue a corrected sentencing order in conjunction with the intent expressed in the Superior Court s October 2005 order. (2) A review of the Superior Court docket in Murray s case reflects that the Superior Court entered a modified sentencing order on July 27, 2006. Accordingly, Murray s petition for a writ of mandamus is moot. NOW, THEREFORE, IT IS ORDERED that Murray s petition for a writ of mandamus is DISMISSED. BY THE COURT: /s/Henry duPont Ridgely Justice
