[Modification of Opinion (24 Cal. 4th 243 ).]

THE COURT.-

The opinion herein, appearing at 24 Cal. 4th 243, is modified as follows:

In the third complete paragraph on page 286, the second sentence is deleted. In the third sentence of the paragraph, the second word, "also," is deleted. As a result of these modifications, the first two sentences in the paragraph read: "The defense also presented evidence to cast doubt on defendant's role in the prison assaults, particularly the killing of Jesse Apodaca. It called two witnesses, Guadelupe Navarro and Jorge Rameriz Acosta, also then incarcerated at Folsom, who controverted other accounts of the stabbing."

The modification does not effect a change in the judgment.
