No. 01CC02874 MODIFICATION OF OPINION THE COURT: The opinion herein, appearing at 47 Cal.4th 1327, is modified as follows: In the second paragraph on 47 Cal.4th at page 1331, insert the following sentence after the second sentence (which ends with but sued only the Lozanos for breach of contract ): Plaintiffs residential purchase agreement with the Lozanos contained a bilateral provision authorizing attorney fees for a prevailing party. This modification does not affect the judgment.
