GAUT, J.-

Defendant and Appellant's petition for rehearing is denied. The opinion filed in this matter on April 8, 2002, is modified as follows:

1. On page 11, line 7 [97 Cal. App. 4th 509, advance report, 1st par., line 6], delete the sentence beginning with "A DNA profile" and insert the following in its place: "A DNA profile is information developed by the Department of Justice. Whether it is a property or thing is not germane here."

Except for this modification, the opinion remains unchanged. This modification does not effect a change in the judgment.
