WUNDERLICH, J.-

It is ordered that the opinion filed herein on August 2, 2000, be modified as follows:

1) On page 14, the first two sentences of the third full paragraph [82 Cal. App. 4th 950, adbance report, 1st par., lines 1-6] beginning with "In the present case, . . ." are omitted and replaced with the following two sentences:

"In the present case, it is undisputed that Eymil was emancipated by an order of the Santa Clara Superior Court on May 8, 1995. This means that the one-year statute of limitations began running on the date of emancipation and expired no later than May 9, 1996."

There is no change in the judgment.

The petition for rehearing is denied.
