GOOD CAUSE appearing, the opinion filed November 17, 2011, in the above entitled matter is hereby modified as follows: On page 2, last paragraph, second sentence that reads: One seemingly incriminating, but eventually debunked, link between Montiel and Taracena was the fact that Montiel s brother was related by marriage to a man named Gustavo Valdiva, which was the name of one of Taracena s accomplices. Should be deleted and replaced with the following sentence: One seemingly incriminating, but eventually debunked, link between Montiel and Taracena was the fact that Montiel s brother was related by marriage to a man who shared the same last name Valdiva as Gustavo Valdiva, who was one of Taracena s accomplices. On page 4, first paragraph, second sentence that reads: First, she conducted the Choicepoint search of Montiel s relative without Montiel s approval (a claim which we have noted the jury implicitly rejected). Should be deleted and replaced with the following sentence: First, she conducted the Choicepoint search of Gustavo Valdiva without Montiel s approval (a claim which we have noted the jury implicitly rejected). On page 11, first full paragraph, third sentence that reads: The gravamen of Cordero-Sacks s claim is that the Authority fired her for her Choicepoint searches of Gustavo Valdiva, who was related by marriage to the Authority s president, Rudolf Montiel. Should be deleted and replaced with the following sentence: The gravamen of Cordero-Sacks s claim is that the Authority fired her for her Choicepoint searches of Gustavo Valdiva, who shared the last name of a man related by marriage to the brother of the Authority s president, Rudolf Montiel.
