The text of the footnote is to read as follows: Subsequent to the events in this case, the State Department of Health Services was reorganized into the Department of Health Care Services and the Department of Public Health. As corresponding amendments have not yet been made to Government Code section 855, and no regulations of the newly reorganized departments are at issue in this case, we use the pre-reorganization terminology in our discussion. The remaining footnotes are to be renumbered accordingly. There is no change in the judgment. 2
