Filed 10/26/06 CERTIFIED FOR PUBLICATION IN THE COURT OF APPEAL OF THE STATE OF CALIFORNIA THIRD APPELLATE DISTRICT (Siskiyou) ---- BRV, INC., C050224 Petitioner, (Super. Ct. No. SCSCCVPT 04-1402) v. THE SUPERIOR COURT OF SISKIYOU COUNTY, Respondent; ORDER MODIFYING OPINION AND DENYING REHEARING [NO CHANGE IN JUDGMENT] DUNSMUIR JOINT UNION HIGH SCHOOL DISTRICT et al., Real Parties in Interest. THE COURT: It is ordered that the opinion filed herein on September 29, 2006, be modified as follows: 1. In Discussion section IV, B, the first full paragraph beginning on page 24 is deleted and replaced with the following paragraph: 1 We note, however, that the public s interest in viewing the Davis report is not furthered by knowing the identities of any of the students, parents, staff members, or faculty members interviewed or mentioned in the report. Nothing in the record indicates these persons are public officials such as Morris. Knowing their identities does not help the public understand how the Board responded to the allegations involving Morris. We will thus direct that names, home addresses, phone numbers, and job titles for such persons be redacted before the report is released. (See, e.g., Teamsters Local 856 v. Priceless, LLC, supra, 112 Cal.App.4th at pp. 1521-1523.) 2. In the Disposition, the first full paragraph under that heading on page 24 is deleted and replaced with the following paragraph: The petition for extraordinary writ is granted. The District shall release to BRV the Davis report in its entirety (consisting of approximately 257 pages in total, including the letter detailing Davis s findings and opinions, the interview summaries, any memoranda written by Davis, and her interview notes), subject first to redacting the names, home addresses, phone numbers, and job titles of all persons mentioned in the report other than Morris or elected members of the District s Board. Costs and reasonable attorney fees in this proceeding are awarded to petitioner. (ยง 6259, subd. (d).) 2 This modification does not change the judgment. The petition for rehearing is denied.
