PRO SE MOTION TO WITHDRAW MOTION FOR RULE ON CLERK TO FILE MANDAMUS PETITION WITHOUT RECORD [CIRCUIT COURT OF PULASKI COUNTY, NO. CV 2002-4161]

MOTION GRANTED

Petitioner James Michael Stickley tendered to this court a petition for writ of mandamus contending that a circuit judge had failed to perform some duty with respect to a civil pleading he had filed. Petitioner subsequently filed a motion for rule on clerk seeking to file the mandamus action without the certified record required by our clerk to file such an action.

Petitioner then filed the instant motion to withdraw the motion for rule on clerk on the ground that the matter in circuit court had been resolved. As there is no basis on which this court can assume jurisdiction of a matter without a certified record in any event, the motion to withdraw the motion for rule on clerk is granted.

Motion granted.
