James Munson was found guilty in 1996 of violation of a minor in the first degree and sentenced to a term of fifteen years' imprisonment. We affirmed. Munson v. State, 331 Ark.418, 59 S.W.2d 391 (1998).

In 2001, Munson filed in the trial court a petition for writ of habeas corpus challenging the judgment. The petition was denied, and Munson lodged an appeal from the order in this court on October 23, 2001. Appellant Munson did not file the appellant's brief which was due on December 3, 2001. On December 5, 2001, he filed the instant motion to dismiss the appeal.

The motion is granted.
