APPELLANT'S COUNSEL'S MOTION TO RELEASE SEALED PORTIONS OF RECORD,

Per Curiam

Chris Averitt, counsel for appellant Southeastern Distributing Co., Inc., has filed a motion to check out sealed portions of the record. Mr. Averitt represents that access to the entire record is necessary in order to adequately prepare appellant's abstract, brief, and addendum. We grant the motion and order that both appellant's counsel and appellee Miller Brewing Company's counsel be provided access to the sealed material, and that immediately thereafter, the records shall be resealed. We direct that both appellant's and appellee's abstracts and briefs be submitted to this court under seal if any reference is made to the sealed material, and in such event, only the appellee shall be permitted to access appellant's brief and only the appellant shall be permitted to access the appellee's brief. We extend the brief time such that appellant's brief is now due thirty days from the date of this opinion, which is October 28, 2005.
