I write separately to explain my disagreement with the rationale employed by the Court of Civil Appeals as to one of the several issues presented to that court. First, I note my agreement with the conclusion of the Court of Civil Appeals as to the primary issue presented, i.e., the intent of the legislature as to the retroactivity of § 40-23-62(1), Ala. Code 1975, as amended by Act No. 97-301, Ala.
