The [ g r a n d m o t h e r ] must f i l e a d e p e n d e n c y p e t i t i o n a n d meet t h e b u r d e n o f p r o o f as s e t o u t b y t h e Code o f A l a b a m a . T h i s c o u r t has j u r i s d i c t i o n i n t h i s p r o c e e d i n g p u r s u a n t t o A l a b a m a Code S e c . 12-15-103 to hear t h i s p r o c e e d i n g . [The grandmother] avers that the minor c h i l d i s dependent and t h a t the mother i s not a f i t and p r o p e r p a r t y t o have t h e c a r e , c u s t o d y and c o n t r o l of s a i d minor c h i l d . "3. The f a t h e r o f s a i d c h i l d was [ J . M . P . ( ' t h e father')]. On J a n u a r y 2 9 , 2 0 1 0 , [ t h e f a t h e r ] p a s s e d away. "4. P r e v i o u s l y , i n 2005, [the f a t h e r ] and [ t h e m o t h e r ] were d i v o r c e d i n F r a n k l i n C o u n t y , Alabama. I n the o r i g i n a l d i v o r c e , temporary custody of the m i n o r c h i l d was v e s t e d i n t h e m a t e r n a l g r a n d m o t h e r f o r a p e r i o d o f one y e a r . A t t h e e n d o f one y e a r , the [mother and t h e f a t h e r ] began sharing joint physical and legal custody of said child, alternating weeks of custody. "In 2007, t h e [mother and t h e f a t h e r ] were t o s h a r e c u s t o d y on a w e e k t o w e e k b a s i s . However, s h o r t l y a f t e r s a i d o r d e r was e n t e r e d , t h e m o t h e r b a s i c a l l y abandoned t h e c h i l d [ ] and l e f t [her] w i t h the father. F o r a p e r i o d o f t h r e e y e a r s , she had l i t t l e o r no c o n t a c t w i t h t h e c h i l d [ ] a n d d i d n o t e x e r c i s e any c u s t o d y r i g h t s . During t h i s time, the c h i l d was with the f a t h e r or w i t h the paternal g r a n d m o t h e r who e x e r c i s e d p r i m a r y p h y s i c a l c u s t o d y and c a r e of t h e minor c h i l d . "5. At the time of the f a t h e r ' s d e a t h , the whereabouts of the mother were difficult to a s c e r t a i n a n d c o u l d n o t be f o u n d . The paternal grandmother filed a petition f o r custody i n the d o m e s t i c r e l a t i o n s case and s e r v i c e by p u b l i c a t i o n was h a d u p o n t h e m o t h e r . The m o t h e r d i d f i l e an answer and c o n t e s t e d t h e j u r i s d i c t i o n of t h e c o u r t in t h a t t h e g r a n d m o t h e r was not a p a r t y to the divorce. S a i d c a s e was d i s m i s s e d on J u l y 7, 2 0 1 0 . " 6 . [The g r a n d m o t h e r ] a v e r s t h a t t h e m i n o r c h i l d i s dependent and t h a t t h e mother i s not a f i t and p r o p e r p a r t y t o have t h e c a r e , c u s t o d y and c o n t r o l of s a i d m i n o r c h i l d . S p e c i f i c a l l y , t h e mother has not been s u p p o r t i v e of the minor c h i l d , has had numerous c r i m i n a l o f f e n s e s s i n c e 2007 i n c l u d i n g , b u t not limited to assault, burglary, possession of n a r c o t i c equipment and bad c h e c k c h a r g e s . These a p p e a r t o have o c c u r r e d f o r t h e most p a r t i n t h e s t a t e of F l o r i d a . The m o t h e r h a s c o n s i s t e n t l y h a d a s u b s t a n c e abuse p r o b l e m w h i c h has not been t r e a t e d and c o n t i n u e s t o impede her a b i l i t y to properly parent the minor c h i l d . "7. The [ g r a n d m o t h e r ] a v e r s t h a t she has and w i l l c o n t i n u e t o p r o v i d e a l o v i n g a n d n u r t u r i n g home for the minor c h i l d [ ] . [The g r a n d m o t h e r ] i s f u l l y 5 2091118; 2091119 capable of continuing to e x e r c i s e custody of the minor c h i l d and t o p r o v i d e h e r a l o v i n g [and] s t a b l e home e n v i r o n m e n t , s o m e t h i n g t h a t t h e [ g r a n d m o t h e r ] avers t h e mother cannot p r o v i d e . "8. The [ g r a n d m o t h e r ] avers that after the issuance o f t h e o r d e r on J u l y 7, 2 0 1 0 , t h e m o t h e r has taken t h e c h i l d and l e f t the j u r i s d i c t i o n of Alabama. I t w i l l be n e c e s s a r y t h a t s e r v i c e , once a g a i n , be h a d upon t h e m o t h e r a n d t h a t t h i s court w i l l need t o s e t a h e a r i n g t o r e q u i r e t h e mother t o r e t u r n t h e c h i l d t o Alabama f o r d i s p o s i t i o n i n t h i s case. B o t h p a r t i e s s t o o d b e f o r e t h e C o u r t on J u l y 8, 2 0 1 0 , a n d h a d t h e i r a t t o r n e y r e c i t e an a g r e e m e n t b e t w e e n the p a r t i e s to allow [the grandmother] to have grandparent v i s i t a t i o n . [The grandmother] s t a t e d affirmatively on t h e r e c o r d t h a t s h e w i s h e d the Court to accept t h i s agreement. The C o u r t g r a n t e d t h e M o t i o n t o R e i n s t a t e so t h a t a f o r m a l w r i t t e n a g r e e m e n t c o u l d be s u b m i t t e d t o t h e C o u r t e v i d e n c i n g t h i s agreement.
