§28-5-14. Bids for convict labor -- Opening.
The bids shall be opened by the commissioner of public institutions at his next meeting after the last day and hour specified for receiving bids, and the labor shall be awarded to the highest bidder, subject to the following regulations: (a) As between bids which are for substantially the same price, the commissioner may give preference to the one which, in his judgment, best promotes the interest of the state; (b) as between bids of the same party one with and the other without the exclusive right to manufacture, the commissioner may accept either; (c) the commissioner may reject all bids, if they are for less than a fair and reasonable price for the labor bid for, and the commissioner shall not be required in any case to apportion the labor advertised among the bidders, or any number of them; (d) any bid may be rejected, if it is against the interests of the state, or the welfare of the convict, that the articles should be manufactured.
