The deposition of any person taken pursuant to this chapter may be used as
evidence in the trial of any judicial proceeding in any court, or town council,
or before commissioners, masters in chancery, referees, or auditors, in which
it shall have been taken to be used; and if the party who took the deposition
shall neglect to produce or use it, the adverse party may use the original or a
copy of the deposition, certified by the magistrate before whom it was taken.
