§ 1A‑1.  Rules of Civil Procedure.

The Rules of Civil Procedure are as follows:

Scope of Rules–One Form of Action.

Rule 1.  Scope of rules.

These rules shall govern the procedure in the superior and district courts of the State of North Carolina in all actions and proceedings of a civil nature except when a differing procedure is prescribed by statute.  They shall also govern the procedure in tort actions brought before the Industrial Commission except when a differing procedure is prescribed by statute. Rule 2. One form of action.

There shall be in this State but one form of action for the enforcement or protection of private rights or the redress of private wrongs, which shall be denominated a civil action. (1967, c. 954, s. 1.)
