New York Competitive Bidding.




 
    §  259.  Competitive bidding. The board shall establish procedures and
  guidelines for competitive bidding  which  shall  be  utilized  by  such
  non-profit  racing  association  in  the  procurement  of  all goods and
  services necessary  to  accomplish  the  capital  improvements  financed
  pursuant  to  this article. Such procedures and guidelines shall include
  (a) provisions that no construction contract shall be awarded except  to
  the  lowest  responsible and reliable bidder; (b) provisions that any or
  all bids may be  rejected  or  any  informality  waived  if  the  public
  interest will be served thereby; and that any bid may be rejected if the
  technical   organization,   plan,   resources,   financial  standing  or
  experience of the bidder justifies such  rejection  in  accordance  with
  criteria previously approved by the board; and (c) such other procedures
  and  guidelines  as  the  board shall deem to be necessary, desirable or
  appropriate.
