§ 252. Definitions. As used in this article, the following terms
shall have the following meanings:
1. "Board". The board of directors of the fund as such board is
constituted pursuant to section two hundred fifty-three of this article.
2. "Capital improvement". Seating stands in the grandstand, clubhouse
or elsewhere utilized as part of the racing facilities, buildings
including but not limited to backstretch and paddock facilities,
stables, parking lots, track and infield areas, fencing, signing,
equipment and other structures, appurtenances and machinery which may be
necessary, desirable or incidental to the operation of thoroughbred
racing at the racing facilities of the non-profit racing association
including acquisition of real property or interests therein and
improvements necessary or appropriate in connection therewith.
3. "Capital plan". The capital plan means a plan of capital
improvements conforming to the requirements of section two hundred
fifty-eight of this article.
4. "Comptroller". The comptroller of the state of New York.
5. "Cost". The cost of planning, acquiring, constructing,
reconstructing, improving, equipping and furnishing a capital
improvement and of placing of same in operation including the costs of
legal, administrative, engineering, consulting and technical services,
insurance, financing and refinancing costs, and any other costs
incidental or properly attributable thereto.
6. "Director of the budget". The director of the division of the
budget of the state of New York.
7. "Fund". The New York state thoroughbred racing capital investment
fund established by section two hundred fifty-three of this article.
8. "Non-profit racing association". An association incorporated under
section one-a of chapter four hundred forty of the laws of nineteen
hundred twenty-six which has been granted franchises for the conduct of
running races, steeplechases or hunt meetings and for the conduct of
pari-mutuel betting on the outcome thereof either by the state racing
commission or its successor, the state racing and wagering board.
9. "Races". Races upon which pari-mutuel wagering is conducted at
thoroughbred race meetings of such non-profit racing association as
authorized by the state racing and wagering board.
10. "Racing facility". The thoroughbred racing facilities located in
Queens county, Saratoga county or jointly located in Nassau and Queens
counties and known as Belmont Park racetrack, Aqueduct racetrack and
Saratoga thoroughbred racetrack, including structures, seating stands,
buildings, barns, racing or training tracks, and all other capital
improvements not herein specifically set out and all appurtenances upon
any of the foregoing.
