§ 103. Commissions continued. In order to provide the board with
assistance and advice concerning horse racing and pari-mutuel wagering,
the following commissions shall be reconstituted pursuant to this
section, having the general or specific powers, functions, and duties
set forth herein: the state racing commission, the state harness racing
commission and the state off-track pari-mutuel betting commission.
1. Each commission shall consist of three members appointed by the
governor by and with the advice and consent of the senate. No more than
two of such appointees shall be members of the same political party.
The governor shall designate a chairman of each commission from among
its members.
2. Of the three members first appointed to each commission, one shall
be appointed for two years, one for four years and one for six years
from February first next succeeding the date of their appointments.
Their successors shall be appointed for terms of six years, except that
in the event of a vacancy occurring by death, resignation or otherwise a
successor shall hold office for the unexpired term.
3. The governor may remove any commission member in the same manner as
provided by subdivision four of section one hundred one of this chapter.
4. The chairman of each commission shall receive an annual salary
within the amount appropriated therefor and the other members shall
receive a per diem allowance to be fixed by the governor, within the
amount appropriated therefor, for each day actually spent in the
performance of their duties. The chairmen and other members shall
receive actual and necessary expenses incurred by them in the
performance of their duties. Neither the chairmen nor the other members
shall hold any other public office or public employment for which they
shall receive compensation other than necessary travel or other expenses
incurred in the performance of such other office or employment. They may
engage in private employment or in a profession or business, provided
such private employment, profession or business does not interfere with
the performance of their duties as commissioners.
5. Each commission shall provide the board with an annual report
consisting of its observations and recommendations pertaining to racing
and wagering, with particular emphasis on its special area of expertise.
Each commission may, from time to time, make any other recommendations
or propose to the board any rules applicable to its area of concern.
Each commission may visit and inspect any racing or wagering facility
and shall provide expertise and such supplementary services as the board
may require.
6. The state racing commission, the state harness racing commission
and the state quarter horse racing commission shall have the powers,
functions and duties with respect to the respective horse breeding
development funds prescribed by this chapter.
7. The commissions may each appoint a secretary and such clerical
employees as may be provided for by appropriation.
