- The doctrine of cy-pres was applied by the court in its determination that a devise to the "Masonic Lodge for Crippled Children" should be construed to designate a charitable intent to leave certain described lands to the Shriners Hospitals for Crippled Children. In re Estate of Bernstrauch, 210 Neb. 135, 313 N.W.2d 264 (1981).
A charitable trust will not be permitted to fail for want of competent trustee to administer it. In re Estate of Halstead, 154 Neb. 31, 46 N.W.2d 779 (1951).
