     256M.40 Children and community services grant allocation.

    Subdivision 1.    Formula.  The commissioner shall 
 allocate state funds appropriated for children and community 
 services grants to each county board on a calendar year basis in 
 an amount determined according to the formula in paragraphs (a) 
 to (c). 

    (a) For July 1, 2003, through December 31, 2003, the 
 commissioner shall allocate funds to each county equal to that 
 county's allocation for the grants under section 256M.10, 
 subdivision 5, for calendar year 2003 less payments made on or 
 before June 30, 2003. 

    (b) For calendar year 2004 and 2005, the commissioner shall 
 allocate available funds to each county in proportion to that 
 county's share of the calendar year 2003 allocations for the 
 grants under section 256M.10, subdivision 5. 

    (c) For calendar year 2006 and each calendar year 
 thereafter, the commissioner shall allocate available funds to 
 each county in proportion to that county's share in the 
 preceding calendar year. 

    Subd. 2. Repealed, 1Sp2005 c 4 art 3 s 20 

*   NOTE:  Subdivision 2 was also amended by Laws 2005, First 
*Special Session chapter 4, article 5, section 14, to read as 
*follows: 

*   "Subd. 2.    Project of regional significance; study.  
*The commissioner shall study whether and how to dedicate a 
*portion of the allocated funds for projects of regional 
*significance.  The study shall include an analysis of the amount 
*of annual funding to be dedicated for projects of regional 
*significance and what efforts these projects must support.  The 
*commissioner shall submit a report to the chairs of the house 
*and senate committees with jurisdiction over children and 
*community services grants by January 15, 2005." 

    Subd. 3.    Payments.  Calendar year allocations under 
 subdivision 1 shall be paid to counties on or before July 10 of 
 each year.
