Sec. 1.
Short title.
This Act may be cited as the Building and Construction Contract Act.

Sec. 5.
Definition.
In this Act:
"Building and construction contract" means a contract for the
design,
construction, alteration, improvement, repair, or maintenance of real property,
highways,
roads, or bridges.

Sec. 10.
Application of laws of another state.
A provision contained
in
or
executed in connection with a building and construction contract to be
performed in
Illinois that makes the contract subject to the laws of another state or that
requires any
litigation, arbitration, or dispute resolution to take place in another
state is against
public policy. Such a provision is void and unenforceable.

Sec. 15.
Contracts of the United States or any other state.
This Act
shall not apply to provisions contained in or executed in connection with any
building and construction contract awarded by the United States or by any other
state.

Sec. 20.
Business of selling tangible personal property.
This Act shall
not apply to any person
primarily engaged in the business of selling tangible personal property.

Effective date.
This Act takes effect upon becoming law.
