                             IRRIGATION DISTRICTS
                                  CHAPTER 3
                             POWERS AND DUTIES OF
                              BOARD OF DIRECTORS
    43-330C.  COMPLIANCE. If the contract provides for construction of any
portion of the distribution system by the owner or owners, chapter 9, title
43, Idaho Code, shall not be  applicable to that portion of the construction.
If any portion of the distribution system is to be constructed by the
district, the district shall comply with the provisions of chapter 9, title
43, Idaho Code, insofar as applicable  to the construction to be performed by
the district or by a contractor under a separate contract with the district,
unless the owner or owners furnish a written waiver of such compliance.
