                                  CHAPTER 39
                      WASTE DISPOSAL AND INJECTION WELLS
    42-3919.  CRIMINAL PENALTY -- WILLFUL VIOLATION -- VIOLATION OF CEASE AND
DESIST ORDER. Any person who willfully constructs, operates, maintains,
converts, plugs, abandons, or conducts any other activity in a manner that
results or may result in the injection of a hazardous waste or of a
radioactive waste through an injection well in violation of section 42-3902A,
Idaho Code, or any person who willfully violates any cease and desist order
after the same has been served on that person is guilty of a misdemeanor and:
    (1)  May be sentenced to jail for a period not to exceed six (6) months;
    (2)  May be fined in an amount not to exceed five thousand dollars
($5,000) for each offense; and
    (3)  Each day of violation shall constitute a separate offense.
