    37-119.  PROSECUTIONS OF VIOLATIONS -- RIGHT OF PARTY TO NOTICE AND
PRESENTATION OF VIEWS PRIOR TO PROSECUTION. It shall be the duty of each
county prosecuting attorney to whom the director or his agent reports any
punishable violation of this act (including, but not limited to, rules and
regulations) to cause appropriate proceedings to be instituted in the proper
court without delay and to be prosecuted in the manner required by law. Before
any violation of this act is reported to the county prosecuting attorney for
the institution of a criminal proceeding, the person against whom such
proceeding is contemplated shall be given appropriate notice and an
opportunity to present his views before the director or his designated agent,
either orally or in writing, in person, or by attorney, with regard to such
contemplated proceeding.
