THEFT
18-2415. SCANNING -- REENCODING. (1) As used in this section, the term:
(a) "Scanning device" means a scanner, reader, or any other electronic
device that is used to access, read, scan, obtain, memorize, or store,
temporarily or permanently, information encoded on the magnetic strip or
stripe of a payment card.
(b) "Reencoder" means an electronic device that places encoded
information from the magnetic strip or stripe of a payment card onto the
magnetic strip or stripe of a different payment card.
(c) "Financial transaction card" or "FTC" means any instrument or device
known as a credit card, credit plate, bank services card, banking card,
check guarantee card, debit card, telephone credit card or by any other
name issued by the issuer for the use of the card holder in obtaining
money, goods, services, or anything else of value on credit, or in
certifying or guaranteeing to a person or business the availability to the
card holder of the funds on deposit that are equal to or greater than the
amount necessary to honor a draft or check payable to the order of such a
person or business; or any instrument or device used in providing the card
holder access to a demand deposit account or a time deposit account for
the purpose of making deposits of money or checks therein, or withdrawing
funds in the form of money, money orders, or traveler's checks or other
representative of value therefrom or transferring funds from any demand
account or time deposit account to any credit card account in full or
partial satisfaction of any outstanding balance existing therein.
(d) "Merchant" is defined as an owner or operator of any retail
mercantile establishment or any agent, employee, lessee, consignee,
officer, director, franchisee, or independent contractor of such owner or
operator. A "merchant" means a person who receives from an authorized user
of a payment card, or someone the person believes to be an authorized
user, a payment card or information from a payment card, or what the
person believes to be a payment card or information from a payment card,
as the instrument for obtaining, purchasing or receiving goods, services,
money or anything else of value from the person.
(2) It is a felony for a person to use or possess with intent to use:
(a) A scanning device to access, read, obtain, memorize, or store,
temporarily or permanently, information encoded on the magnetic strip or
stripe of a payment card without the permission of the authorized user of
the payment card and with the intent to defraud the authorized user, the
issuer of the authorized user's payment card, or a merchant.
(b) A reencoder to place information encoded on the magnetic strip or
stripe of a payment card onto the magnetic strip or stripe of a different
card without the permission of the authorized user of the card from which
the information is being reencoded and with the intent to defraud the
authorized user, the issuer of the authorized user's payment card, or a
merchant.
(3) Any person who commits a violation pursuant to this section shall be
punished pursuant to the provisions of section 18-2408(2)(a), Idaho Code.
