Subchapter IV — Substitute Teachers


§ 1230. Substitute teachers.

(a) The Professional Standards Board and the State Board of Education shall promulgate and adopt rules and regulations pursuant to this chapter that are relative to the licensure of substitute teachers and such rules and regulations shall include at least 3 classifications for substitutes as follows:

Class A -- A Class A license may be issued to an applicant who holds a valid Delaware teacher's license or such a license that has expired. In the case of a license that has expired, the applicant for the substitute license shall not be required to present refresher courses for issuance of the substitute's license.

Class B -- A Class B license may be issued to an applicant with or without a bachelor's degree who meets at least the requirements for a temporary emergency license as set forth in §§ 1313 and 1315 of this title.

Class C -- A Class C license may be issued to an applicant who is not eligible for either Class A or Class B licensure but who is recommended to the Secretary of Education by the chief school officer of a Delaware school district.

(b) A school district may employ a retired teacher to be a substitute teacher within that district and such employment shall not decrease or otherwise adversely affect such retired person's pension or retirement benefits. It also will not increase the retired person's pension. The retired person will be paid regular substitute teacher pay. (14 Del. C. 1953, § 1230; 56 Del. Laws, c. 418, § 1; 57 Del.
