32.1-289. Definitions.

As used in this article:

"Anatomical gift" or "organ donation" means a donation of organs,tissues, or eyes or all of a human body to take effect upon or after death.

"Decedent" means a deceased individual and includes a stillborn infant orfetus.

"Document of gift" means a card, a statement attached to or imprinted on amotor vehicle driver's or chauffeur's license or the record of theindividual's motor vehicle driver's or chauffeur's license, a will, anadvance directive, or other writing used to make an organ donation or ananatomical gift.

"Donor" means an individual who makes a donation of organs, tissues, oreyes or an anatomical gift of all of his body.

"Eye Bank" means an agency certified by the Eye Bank Association of Americaoperating in this Commonwealth.

"Hospital" means a facility licensed, accredited or approved as a hospitalunder the laws of any state or certified by the Health Care FinancingAdministration, and a hospital operated by the United States government, astate, or a subdivision thereof which is not required to be licensed understate laws.

"Organ procurement organization" means an agency certified by the UnitedStates Health Care Financing Administration as an organ procurementorganization.

"Part" means an organ, tissue, eye, bone, artery, blood, fluid, or otherportion of a human body.

"Person" includes, in addition to the entities enumerated in 32.1-3, agovernment and a governmental subdivision or agency.

"Physician" or "surgeon" means an individual licensed or otherwiseauthorized to practice under the laws of any state.

"State" means any state, district, commonwealth, territory, insularpossession, or other area subject to the legislative authority of the UnitedStates of America.

"Tissue Bank" means an agency certified by the American Association ofTissue Banks operating in this Commonwealth.
