§ 405. Allowance to children, before payment of debts

When a person dies leaving children under seven years of age having no mother or when the mother dies before the children arrive at the age of seven years, an allowance shall be made for the necessary maintenance of such children until they become seven years of age, out of such part of the personal estate and the income of such part of the real or personal estate as would have been assigned to the mother, if she had been living. Such allowance shall be made before any distribution of the estate among creditors, heirs, devisees or legatees. (Amended 1959, No. 262, § 29, eff. June 11, 1959.)
