Section 7-31-30 - Proceedings to set aside installment contract in default.
7-31-30. Proceedings to set aside installment contract in default. In lieu of or in addition to the forfeiture by notice as hereinbefore provided, in the discretion of the board of county commissioners such contract may be set aside by an action in the circuit court of the county in which said real estate is situated, under the proceedings provided for the strict foreclosure of real estate contracts, or under other proceedings provided by law, and the state's attorney shall conduct all said proceedings upon request of the board of county commissioners.Source: SL 1941, ch 37; SDC Supp 1960, § 12.3404 (12).
