2006 South Dakota Code - 3-22-11 — Establishment of amount to settle claim--Refusal of member to consent to settlement--Liability of fund.

     3-22-11.   Establishment of amount to settle claim--Refusal of member to consent to settlement--Liability of fund. In any claim in which the PEPL is involved, the bureau may establish the amount at which it would settle the claim. If the claimant is willing to settle within the amount established by the bureau and the member refuses to consent, the director shall certify the amount agreed upon to the member and thereafter the fund is not liable for any claim, including attorney's fees and expenses, beyond the amount certified.
