15-26A-44. Liability of sureties on dismissal of appeal. The dismissal of an appeal by the appellant, or by the court for want of prosecution, unless the court shall at the time otherwise expressly order, shall render the sureties upon any undertaking, given under this title, liable in the same manner and to the same extent as if the judgment or order appealed from had been affirmed.Source: SDC 1939 & Supp 1960, § 33.0728; SDCL, § 15-28-8.
