2005 Rhode Island Code - § 33-11-47 — Restriction on actions against insolvent estate.

    Except as provided in §§ 33-11-9 and 33-11-44, no action shall be maintained against an executor or administrator after an estate has been represented insolvent; provided, that a creditor who, under the provisions of § 33-11-5, may file his or her claim after the expiration of six (6) months from the date of the first publication of notice, may, if the assets prove more than sufficient to pay all claims allowed or proved, file and prosecute his or her claim at any time before the complete distribution of surplus assets.
