5838 - Effect of divorce.

     § 5838.  Effect of divorce.
        If the spouse of a principal is designated as the principal's
     mental health care agent and thereafter either spouse files an
     action in divorce, the designation of the spouse as mental
     health care agent shall be revoked as of the time the action is
     filed unless it clearly appears from the mental health power of
     attorney that the designation was intended to continue to be
     effective notwithstanding the filing of an action in divorce by
     either spouse.
