[§ 3734.13.3] § 3734.133. Reimbursement of expenses and lost wages of nonparty witness.
 

Any nonparty identified in division (A)(1) of section 3734.131 [3734.13.1] of the Revised Code who has received pursuant to the consent-to-jurisdiction document required under division (A)(1) or (3) of that section a subpoena to appear and testify at any civil or criminal proceedings arising out of or relating to solid wastes shipped from outside this state to a solid waste facility in this state may petition the director of environmental protection for the reimbursement of the reasonable and documented loss of wages and expenses incurred by the nonparty during the time for which he was ordered to appear. The director shall adopt, and may amend, suspend, and rescind, rules in accordance with Chapter 119. of the Revised Code governing the procedures for making those reimbursements. The maximum amount that any individual may recover under this section is one hundred dollars per day. The reimbursement provided under this section is in lieu of any other witness fees or compensation to which the individual otherwise may be entitled under the laws of this state or the United States.
