2006 New York Code - Storage Of Combustible Fibres.



 
    §  27-4250  Storage  of  combustible fibres. a. Definition. As used in
  this section, "combustible fibre" means any finely divided vegetable  or
  animal  fibre,  including  paper  and  cloth  in  the  form of scraps or
  clippings, hay, straw, excelsior,  dried  moss  (except  moss  used  for
  medicinal purposes), grasses and similar substances.
    b.  Permit  required.  It shall be unlawful for any person to store or
  keep on hand in any premises any combustible fibre or material in excess
  of one ton without permit from the commissioner; provided, however, that
  rural communities outside of fire limits, no permit  shall  be  required
  for the storage of hay and straw in barns or out of doors, or in stacks,
  where  such stacks are not within fifty feet of a building occupied as a
  dwelling.
    c. Restrictions. No permit shall be issued for  such  storage  in  any
  building or premises:
    1.  Situated  within  fifty  feet  of  the  nearest wall of a building
  occupied as a  school,  hospital,  theatre  or  other  place  of  public
  amusement or assembly;
    2. Which is not equipped with a fire extinguishing system, approved by
  the commissioner;
    3.  Where  the  building  does not comply with the requirements of the
  building code regulating high hazard occupancies for  buildings  erected
  after  the sixth day of December, nineteen hundred sixty-eight; or where
  the building or building section erected  prior  thereto  is  not  fully
  equipped  with  an  approved  automatic  sprinkler  system  or where the
  building is occupied as a multiple dwelling, school,  hospital,  theatre
  or other place of amusement or assembly;
    4.  Where  paints,  varnishes, or lacquers are manufactured, stored or
  kept for sale;
    5.  Where  dry  goods,  or  other  highly  flammable   materials   are
  manufactured, stored, or kept for sale;
    6.  Where  matches,  resin, turpentine or any explosives are stored or
  kept.
    d. Weight limit. It shall be unlawful for any person to store upon any
  floor of a building any combustible fibre exceeding in weight  one-third
  of  the  safe  bearing  capacity  of  such floor, as certified to by the
  department of buildings; or covering, when baled, more  than  two-thirds
  of the floor space of such floor, and no such material shall be piled to
  a  greater  height than two-thirds of the distance from the floor to the
  ceiling.
    e. Exemption. A person who holds a permit, issued under this  chapter,
  for  a  business  to  which the use of combustible fibres is an incident
  shall  not  be  required  to  obtain  an  additional  permit  under  the
  provisions of this section.
    f.  Factories.  The storage of combustible fibres in any building used
  as a factory or workshop, except where  such  combustible  fibre  enters
  into  the  article or material manufactured in such workshop or factory,
  is prohibited unless such combustible fibre does not  exceed  five  tons
  and  is  used  and  stored  in  a  portion  of the premises designed and
  constructed in accordance with all applicable provisions of the building
  code regulating high hazard occupancies for buildings erected after  the
  sixth day of December, nineteen hundred sixty-eight; or where a building
  or  building section erected prior thereto is not fully equipped with an
  approved automatic sprinkler system. In no event  shall  more  than  one
  permit  be  granted  for  the  storage  of combustible fibre in a single
  building used as a factory or workshop.
