2006 New York Limitations On Power Of Commissioner To Designate Administrative Code Provisions Which May Be Enforced By The Environmental Control Board.



 
    §   26-126.4   Limitations  on  power  of  commissioner  to  designate
  administrative  code  provisions  which   may   be   enforced   by   the
  environmental control board. Notwithstanding any other provision of law,
  the  commissioner  may  not  designate  the  following provisions of the
  administrative code for enforcement by the environmental control board:
    (1) Paragraph (6) or (7) of subdivision (c) of section 27-339.
    (2) Subdivision (c) of section 27-353.
    (3) Section 2-4 or 4-4 of building code reference standard RS13-1.
    (4) Paragraph (12) of subdivision (f) of section 27-972.
    (5) Paragraph (10) of subdivision (g) of section 27-972.
    (6) Subdivision (c) of section 27-975.
    (7) Subdivision (c) of section 27-989.
    (8) Section 27-228.
    (9) Any provision of the  administrative  code  specified  in  section
  15-232 of such code.
