§ 159-a. Fire fighting and code enforcement personnel standards and education commission. 1. There is hereby created within the department of state a fire fighting and code enforcement personnel standards and education commission composed of the state fire administrator, the secretary of state and five other members, who shall be appointed by the governor with the advice and consent of the senate. 2. The governor shall designate from among the members of the commission a chairman who shall serve at the pleasure of the governor. 3. All members of the commission appointed by the governor shall be appointed for terms of two years, such terms to commence on April first, and expire on March thirty-first, provided, however, that of the members first appointed two shall be appointed for terms expiring on March thirty-first, nineteen hundred seventy-seven and two shall be appointed for terms expiring on March thirty-first, nineteen hundred seventy-eight. Any member chosen to fill a vacancy created otherwise than by expiration of term shall be appointed for the unexpired term of the member to be succeeded. Vacancies caused by expiration of term or otherwise shall be filled in the same manner as original appointments. Any member may be reappointed for additional terms. Any member appointed to fill an additional position on the commission created in nineteen hundred eighty-one shall be appointed to a term which shall expire on March thirty-first, nineteen hundred eighty-two and his successor shall be appointed for a term of two years. 4. The membership of such commission may include representatives of organizations of fire fighters, organizations of local governments, firemen's organizations, code enforcement organizations and other interested groups. 5. The commission shall meet at least four times in each year. Special meetings may be called by the chairman and shall be called by the chairman at the request of the governor, the secretary of state, the state fire administrator, or upon the written request of three members of the commission. The commission shall establish its own requirements as to quorum and its own procedures with respect to the conduct of its meetings and other affairs; provided, however, that all recommendations made by the commission to the governor shall require the affirmative vote of four members of the commission. The agenda and meeting place of all regular and special meetings shall be made available to the public in advance of such meeting. The state fire administrator or his designee shall act as secretariat for the commission. 6. Commission membership shall not constitute the holding of an office, and members of the commission shall not be required to take and file oaths of office before serving on the commission. The commission shall not have the right to exercise any portion of the sovereign power of the state. 7. The members of the commission shall receive no compensation for their services but shall be reimbursed for their actual and necessary expenses incurred in the performance of their functions within the amount available by appropriation. 8. No member of the commission shall be disqualified from holding any public office or employment, nor shall he forfeit any such office or employment, by reason of his appointment, notwithstanding the provisions of any general, special or local law, ordinance or city charter. 9. For the purposes of sections one hundred fifty-nine-a, one hundred fifty-nine-b, one hundred fifty-nine-c and one hundred fifty-nine-d, the term fire fighter and code enforcement personnel shall mean a member of a fire department whose duties include fire service as the phrase fire service is defined in paragraph d of subdivision eleven of section three hundred two of the retirement and social security law or a code enforcement officer charged with enforcement of building or fire codes.
