2006 New York Code - Warranties And Service Agreements.



 
    § 12-106. Warranties and service agreements. 1. All express warranties
  and  service  agreements  pertaining  to  any  solar  thermal  system or
  component thereof which is sold in the state shall  be  in  writing  and
  shall  be  in compliance with rules and regulations to be promulgated by
  the commissioner. Such rules and regulations shall contain standards  no
  less  stringent  than  those  contained  in  the  Federal  Magnuson-Moss
  Warranty Act (15 U.S.C. §§ 2301 et seq.) and the rules  and  regulations
  issued pursuant thereto.
    2. All customers shall be provided with express warranties which shall
  include at a minimum the following:
    (a)  A  full one year warranty by the installer against malfunction or
  failure of a solar thermal system due  to  improper  installation  or  a
  defect  in  standard  pipe,  ducts, switchboxes and hardware utilized in
  installation;
    (b) A full one year warranty by the system manufacturer and the seller
  against a defect in materials, manufacture or design of a solar  thermal
  system; and
    (c)  A  full  three  year  warranty by the system manufacturer and the
  seller against a defect in materials, manufacture or design of  a  solar
  collector, tank or heat exchanger.
    3.  No  person  shall  offer  a  service agreement for a solar thermal
  system unless such person shall have developed a service capability  for
  such system.
