Section 58-309
Small Business Development Authority; created; members; qualifications.

(1) There is hereby created, with such duties and powers as are set forth in the Small Business Development Authority Act, to carry out the provisions of such act, a body politic and corporate, not a state agency, but an independent instrumentality exercising essential public functions, to be known as the Small Business Development Authority.

(2) The authority shall be composed of seven members appointed by the Governor and two ex officio members. The chairperson of the Nebraska Investment Council and the Director of Banking and Finance shall be ex officio members. One member shall be an officer or employee of the state and six members shall be appointed from the general public. The state government member shall serve at the pleasure of the Governor and may serve as a member as long as he or she is a state officer or is employed by the state.

(3) All members shall be residents of the state. Of the six public members, not more than three shall belong to the same political party. It shall not constitute a conflict of interest for members of the authority to serve on any other public board or commission.
