2005 Montana Code Annotated - 85-9-203 — Hearing by department.


     85-9-203. Hearing by department. (1) Upon receipt of the preliminary survey report, the applicants or any one of them may request the department to hold a hearing. The department shall hold the hearing sooner than 61 days after receipt of the request. Notice of the hearing shall be given in accordance with 85-9-103(9).
     (2) If the department itself initiated the preliminary survey, it may hold a hearing without being requested to do so.
