11-9-119 - Form of scire facias for witness.

§ 11-9-119. Form of scire facias for witness.
 

The scire facias to be issued by the justice for a defaulting witness may be as follows, viz.: 
      "The State of Mississippi.
 


    "To any lawful officer of ________ County:

    "This is to command you to make known to ________ that a judgment in favor of ________ for ten dollars has been given against him by me, a justice of the peace of ________ County, for his default in not appearing before me, at ________ , on the ________ day of ________ A. D. ________ , to testify as a witness for ________ in the case of ________ against ________ , No. ________ as he has been subpoenaed to do; and unless, on the ________ day of ________ , A. D. ________ , before me at ________ , at ________ , o'clock, ________ , he shall show cause to the contrary, the said judgment will be made final; and have there then this writ.

    "Witness my hand this the ________ day of ________ , A. D. ________ J.P."
