Act 338 of 1974 125.1609 Project plan; findings and recommendations of local public agency; determinations; publication of general standards for project plans; local public agency recommendations concerning project plan not required. Sec. 9. (1) A local public agency shall submit its findings and recommendations concerning a project plan after the project citizens district council is consulted and advised as provided in section 14, if it determines the following from the application: (a) The project plan has been submitted to the project citizens district council for its findings and recommendations, if a project citizens district council is required. (b) The project plan meets all the requirements set forth in section 8. (c) The land included within the project area to be acquired is reasonably necessary to carry out the purpose of the plan and of this act in an efficient and economically satisfactory manner. (d) The project plan is in reasonable accord with the master plan of the municipality, if a master plan has been adopted. (e) The project plan and size is practicable and in the public interest. (f) Public services, such as fire and police protection and utilities, are or shall be adequate to service the project area. (g) Changes in zoning, streets, street levels, intersections, and utilities are reasonably necessary for the project and for the municipality. (2) A local public agency may publish general standards for project plans within the provisions of this section. (3) If the implementation of the project plan does not require a zoning change or the taking of private property pursuant to section 22, the recommendations of the local public agency concerning the project plan shall not be required.
