§ 2-805 - Violations; penalties [Subtitle subject to contingency and abrogation]

§2-805. NOT IN EFFECT

(a) A person may not violate a provision of this subtitle, the Northeast Interstate Dairy Compact, or a regulation adopted under this subtitle or the Northeast Interstate Dairy Compact.

(b) Instead of pursuing criminal charges provided in this article, the Secretary may impose on any person who violates this subtitle a civil penalty of:

(1) For a first violation for which a civil penalty is imposed, not more than $500;

(2) For a second violation for which a civil penalty is imposed, not more than $1,000; or

(3) For a third or subsequent violation for which a civil penalty is imposed, not more than $2,000.

(c) Penalties collected by the Secretary under this section shall be paid into the General Fund of the State.

(d) Each day that a violation continues is a separate violation.

(e) The Secretary shall adopt regulations necessary to carry out the provisions of this section.
