§ 24-432.

      (a)      A person may not sell:

            (1)      As new, any bedding or upholstered furniture unless the bedding or upholstered furniture is made entirely from new material;

            (2)      As new, any secondhand filling material;

            (3)      Any bedding that is made from secondhand material unless the bedding is disinfected; or

            (4)      Any bedding, upholstered furniture, or filling material that is not tagged as required under § 24-423 of this subtitle.

      (b)      A person may not sell or transfer any bedding that was used in a hospital or nursing home unless the bedding is disinfected by a licensed disinfector using a disinfection process approved by the Department.

      (c)      A person may not use in making or renovating any bedding or upholstered furniture:

            (1)      Any material that contains bugs, vermin, or filth;

            (2)      Any unsanitary material;

            (3)      Any burlap or other material that has been used for baling; or

            (4)      Any secondhand material, unless the material is disinfected by a process approved by the Department.

      (d)      A person may not:

            (1)      Use any false or misleading statement on a tag;

            (2)      Remove, deface, alter, or attempt to remove, deface, or alter a tag until the tag is in the possession of the consumer;

            (3)      Use any statement on a covering that conflicts with the tag statement; or

            (4)      Use, in describing the material, the words "all", "pure", "100 percent", or any similar statements unless true without variance.
