Article - Financial Institutions

§ 13-701.

      (a)      In this subtitle the following words have the meanings indicated.

      (b)      "Authority" means the Maryland Stadium Authority.

      (c)      "Sports facility" means:

            (1)      Stadiums for the primary purpose of holding professional football games, major league professional baseball games, or both, in the Baltimore metropolitan area, as defined under Regional Planning Council Law;

            (2)      Practice fields, or other areas where professional football or major league professional baseball teams may practice or perform;

            (3)      Offices for professional football and major league professional baseball teams or franchises; and

            (4)      Adjacent properties directly related to an item listed in paragraphs (1) through (3) of this subsection, including:

                  (i)      Parking lots;

                  (ii)      Garages; and

                  (iii)      Other properties.

      (d)      "Baltimore Convention Center facilities" means:

            (1)      Convention centers, trade show facilities, meeting halls, or other structures in Baltimore City used for the holding of conventions, trade shows, meetings, displays, or similar events, including without limitation the Baltimore City Convention Center;

            (2)      Offices, parking lots, garages, access roads, hotels, restaurants, railroad sidings, and any other property, structures, furnishings, or equipment functionally related to the facilities described in paragraph (1) of this subsection; and

            (3)      Other facilities and properties used or useful or having present capacity for future use as, or in connection with, Baltimore Convention Center facilities, including:

                  (i)      Land, buildings, structures, machinery, equipment, and all properties and rights therein and appurtenances thereof, and rights-of-way, franchises, easements, and other interests in land;

                  (ii)      All land and facilities that are functionally related to a Baltimore Convention Center facility; and

                  (iii)      All patents, licenses, and other rights necessary or useful in the construction or operation of a Baltimore Convention Center facility.

      (e)      "Baltimore Convention Center Fund" means the Baltimore Convention Center Financing Fund established under § 13-716 of this subtitle.

      (f)      "Baltimore Convention Center site" means the site of the existing Baltimore Convention Center, at 100 West Pratt Street, and approximately 5.0 acres bounded by Howard Street on the west, Conway Street on the south, Sharp Street on the east, and Pratt Street on the north.

      (g)      "Camden Yards" means approximately 85 acres in Baltimore City in the area bounded by Camden Street on the north, Russell Street on the west, Ostend Street on the south, and Howard Street and Interstate 395 on the east.

      (h)      "Convention Center facilities" means the Baltimore Convention Center facilities, the Ocean City Convention Center facilities, and the Montgomery County Conference Center facilities.

      (i)      "Facility" means a sports facility, other facilities developed on Camden Yards, Convention Center facilities, and Hippodrome Performing Arts Center facilities.

      (j)      "Ocean City Convention Center facilities" means:

            (1)      Convention centers, trade show facilities, meeting halls, or other structures in Ocean City used for the holding of conventions, trade shows, meetings, displays, or similar events, including without limitation the Ocean City Convention Center;

            (2)      Offices, parking lots, garages, access roads, food service facilities, and any other property, structures, furnishings, or equipment functionally related to the facilities described in paragraph (1) of this subsection; and

            (3)      Other facilities and properties used or useful or having present capacity for future use as, or in connection with, Ocean City Convention Center facilities, including:

                  (i)      Land, buildings, structures, machinery, equipment, and all properties and rights therein and appurtenances thereof, and rights-of-way, franchises, easements, and other interests in land;

                  (ii)      All land and facilities that are functionally related to an Ocean City Convention Center facility; and

                  (iii)      All patents, licenses, and other rights necessary or useful in the construction or operation of an Ocean City Convention Center facility.

      (k)      "Ocean City Convention Center Fund" means the Ocean City Convention Center Financing Fund established under § 13-717 of this subtitle.

      (l)      "Ocean City Convention Center site" means the site of the existing Ocean City Convention Center, at 4001 Coastal Highway, and additional land owned by the Town of Ocean City consisting of approximately 3.0 acres located at 3801 Coastal Highway, approximately 3.2 acres located at 200 41st Street, and approximately 3.4 acres located at 200 42nd Street.

      (m)      (1)      "Montgomery County Conference Center facilities" means the Conference Center facility located at the Montgomery County Conference Center site and used for the holding of conferences, trade shows, meetings, displays, or similar events including offices, parking lots, garages, access roads, food service facilities, and any other property, structure, furnishings, or equipment located at the Montgomery County Conference Center site and functionally related to the facilities.

            (2)      "Montgomery County Conference Center facilities" does not include the privately owned hotel that is planned to be developed adjacent to the Conference Center.

      (n)      "Montgomery County Conference Center Fund" means the Montgomery County Conference Center Financing Fund established under § 13-717.1 of this subtitle.

      (o)      "Montgomery County Conference Center site" means a site in close proximity to the White Flint metro station in the north Bethesda area of Montgomery County as determined by the Authority and Montgomery County.

      (p)      "Montgomery County" includes the Montgomery County Revenue Authority.

      (q)      (1)      "Hippodrome Performing Arts Center facility" means the performing arts center facility located at the Hippodrome Performing Arts Center site.

            (2)      "Hippodrome Performing Arts Center facility" includes the Hippodrome theater and offices, food service facilities, and any other property, structure, furnishings, or equipment located at the Hippodrome Performing Arts Center site that are functionally related to the Hippodrome Performing Arts Center facility.

      (r)      "Hippodrome Performing Arts Center Financing Fund" means the Hippodrome Performing Arts Center Financing Fund established under § 13-717.2 of this subtitle.

      (s)      "Hippodrome Performing Arts Center site" means a site in Baltimore City that includes the properties known as:

            (1)      The Eutaw Building, 400-410 West Baltimore Street, described in the Baltimore City Land Records in Liber S.E.B. 4934, Folio 1;

            (2)      The Baltimore Grand, 401 West Fayette Street, also known as the Catering Unit of the Gaslamp Square Condominium, described in condominium declaration recorded in the Baltimore City Land Records at Liber S.E.B. 2558, Folio 513, and in deeds recorded at Liber S.E.B. 1494, Folio 471, Liber S.E.B. 1494, Folio 475, and Liber S.E.B. 1789, Folio 574;

            (3)      The Hippodrome Theatre, 12 North Eutaw Street, described in the Baltimore City Land Records in Liber S.E.B. 6259, Folio 38;

            (4)      Two vacant lots, 412 and 414 West Baltimore Street, described in the Baltimore City Land Records in Liber R.H.B. 3374, Folio 225; and

            (5)      416 West Baltimore Street, described in the Baltimore City Land Records in Liber J.F.C. 960, Folio 199.

      (t)      "Authority affiliate" means any corporation, partnership, limited liability company or other entity, whether organized on a for profit or not for profit basis, if the Authority directly or indirectly owns any outstanding shares of capital stock, partnership interests, membership interests, or other equity interests of such entity.
