Article - Housing Authorities

§ 1-201.

      (a)      All existing housing authorities shall continue in existence.

      (b)      (1)      On or before December 1, 1990, existing housing authorities shall file with the Secretary of State a certification from the secretary of the authority or the custodian of records of the local government stating:

                  (i)      The total number of authorized commissioners;

                  (ii)      The names of the commissioners then in office; and

                  (iii)      Either a copy of the original resolution which authorized the authority or a resolution of the legislative body which states that the authority was previously established and continues in existence.

            (2)      Upon receipt of a certificate filed in accordance with paragraph (1) of this subsection, the Secretary of State shall issue a certificate of organization to the authority.

      (c)      (1)      Except as provided in paragraph (3) of this subsection, existing housing authorities governed by this title and not governed by another title within this article may exercise:

                  (i)      All of the powers granted by §§ 1-301, 1-303, and 1-304 of Subtitle 3 and Subtitles 5 and 6 of this title; and

                  (ii)      If articles of organization are adopted, any powers specified in § 1-302 of this title that are authorized by such articles in accordance with § 1-203(b)(7) of this subtitle.

            (2)      Except as provided in paragraph (3) of this subsection, existing housing authorities governed by this title and governed by another particular title within this article may exercise:

                  (i)      All of the powers granted to them under the particular title applicable to the authority;

                  (ii)      All of the powers granted by §§ 1-301, 1-303, and 1-304 of Subtitle 3 and Subtitles 5 and 6 of this title as modified by the particular title applicable to the authority; and

                  (iii)      If articles of organization are adopted, any powers specified in § 1-302 of this title that are authorized by such articles in accordance with § 1-203(b)(7) of this subtitle.

            (3)      If articles of organization are adopted, the powers set forth in §§ 1-301 through 1-304 of this title may be limited to the extent permitted under §§ 1-203(b)(8) and 1-206 of this subtitle.

      (d)      In any suit, action, or proceeding involving the validity or enforcement of or relating to any contract of an existing housing authority, the authority shall be conclusively deemed to have become established and authorized to transact business and exercise its powers upon issuance by the Secretary of State of a certificate of organization. A copy of such certificate of organization shall be admissible in evidence in any suit, action, or proceeding.
