Article - Alcoholic Beverages

§ 7.5-103.

      The Office of the Comptroller shall issue a direct wine seller's permit to a person or entity that:

            (1)      Is domiciled outside of this State;

            (2)      (i)      Is engaged in the manufacture of wine; or

                  (ii)      Is the brand owner, United States importer, or designated Maryland agent of the brand owner or United States importer for all wine sold under this subtitle;

            (3)      Holds and acts within the scope of any alcoholic beverages license or permit required:

                  (i)      In the state where the applicant is domiciled; or

                  (ii)      By the Federal Bureau of Alcohol, Tobacco and Firearms; and

            (4)      Within 2 years before the application:

                  (i)      Does not hold any alcoholic beverages license or permit issued by this State; and

                  (ii)      Is not owned, as a whole or in part, by any other person or entity that holds another alcoholic beverages license or permit issued by this State or a political subdivision of this State.
