Article - Washington Suburban Sanitary District

§ 18-107.

      (a)      Unless the WSSC takes precautions to make a composting facility free of offensive off-site odors, the WSSC may not construct the facility in any area that has more than 100 homes that are located within 5 miles of the facility.

      (b)      The WSSC shall adopt regulations that provide standards for the construction and operation of a composting facility that is free of offensive off-site odors.

      (c)      If the WSSC does not control and eliminate any offensive off-site odor that is caused by a composting facility that is constructed after July 1, 1986, the WSSC must close the facility within 4 months from the date the offensive off-site odor is emitted from the facility.

      (d)      On or before January 1, 1987, the WSSC shall take all necessary and reasonable actions to make any composting facility in existence on July 1, 1986 free of offensive off-site odors.

      (e)      If a composting facility is closed for failure to meet any standards adopted by the WSSC under this section, the Montgomery County government shall select an alternative method or location for the disposition of sludge located at the closed facility.
