Article - Washington Suburban Sanitary District

§ 10-106.

      (a)      Montgomery County or Prince George's County shall pay one half of the actual cost in the respective county that the WSSC is required to pay for the relocation or removal of any WSSC facility because of any road construction or improvement required by either county.

      (b)      (1)      If a county requires the relocation or removal of any WSSC facility, the appropriate county shall notify the WSSC within a reasonable time of any requirement.

            (2)      On notification, the WSSC shall furnish the appropriate county an estimate of the cost of removing or relocating the facility.

            (3)      On completion of the removal or relocation of the facility, the WSSC shall furnish the county an itemized statement of the actual cost of the removal or relocation.

            (4)      Unless the county disputes any of the charges in the itemized statement of actual costs, the county shall pay the costs within 6 months after receipt of the statement.

            (5)      If there is a dispute over any charge made by the WSSC, the dispute shall be referred within 3 months after receipt of the statement to an arbitrator who is satisfactory to both the WSSC and the county.

            (6)      If the WSSC and the county do not agree on an arbitrator, the WSSC and the county shall each appoint an arbitrator. The 2 arbitrators shall then appoint a third arbitrator.

            (7)      If the itemized statement as rendered or finally agreed on is not paid within 6 months after rendition or agreement, the itemized statement shall bear 6 percent interest until paid. If a dispute goes to arbitration, the statement shall bear 6 percent interest after 6 months from the date of the finding by the arbitrators.
